Terms of Service

1. Overview
These Terms of Service ("Terms") govern your use of makemind.app and its associated products — Makemind Studio, AppPlayer, the Marketplace, and developer tools (collectively, the "Services") — operated by Makemind Ecosystem, Inc ("Company", "we", "us"). By accessing or using the Services, you agree to be bound by these Terms.
2. Account Registration
You may create an account using Google, GitHub, or email authentication. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Please provide accurate registration information and keep it current.
3. Paid Plans and Products
The Services include Studio subscription tiers (Free, Pro, Team, Enterprise), Technical Support packages, managed services (3Flow, FlowHub, Makemind SaaS), and Marketplace purchases (bundles, knowledge packs). The open-source core — AppPlayer, FlowOS, FlowBrain — is free and governed by its respective open-source licenses. Current prices for all plans and products are displayed on the pricing/plans page and at checkout and are not restated here; the published price is the single source of truth.
4. Payment
Charges for the Services are billed by us; we issue your receipt and invoice. Changing or adding a provider does not change these Terms. By subscribing you authorize recurring charges at the then-current rate until you cancel; one-time purchases are charged once. All prices are in USD unless otherwise stated at checkout. Enterprise and custom plans are arranged separately and billed by invoice — they are not sold through the online checkout. Where you use the Services to sell to your own customers, that sale is between you and them. We are not the seller and not a party to it — we connect the payment and record what happened. You set your prices, your policies and your refunds, and you carry the obligations to your customers, including tax.
5. Services and Content
Access to tier-gated features depends on your active subscription level. Open-source components of the platform are governed by their respective open-source licenses, which take precedence over these Terms for those components.
6. Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access until the end of your current billing period, after which your account reverts to the Free tier.
7. Intellectual Property
You retain ownership of the applications, content, and bundles you create using the Services. You grant Makemind a limited, non-exclusive license to host and process your content solely to provide the Services. Makemind retains all rights in its platform, tooling, and documentation.
8. User Conduct
You agree not to: transmit malicious code or interfere with other users; reverse-engineer or attempt to extract the source code of proprietary components; resell or sublicense access to the Services without written permission; use the Services for any unlawful purpose; or circumvent usage limits or access controls.
9. Marketplace and User Submissions
Content and bundles you publish to the Marketplace remain your property. You grant Makemind a license to host and distribute them through the Services. You are responsible for holding all necessary rights and for ensuring your submissions comply with applicable laws. Makemind may review submissions and remove content that violates these Terms.
10. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind. Makemind does not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Your use of the Services is at your sole risk.
11. Limitation of Liability
To the fullest extent permitted by law, Makemind shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
12. Modifications
We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
